What’s Changing?
Implementation of the main changes in the updated code of practice relating to the Right to Work (RTW) checks required for EEA/Swiss nationals after 1st July. The following document types are no longer sufficient to prove right to work:

EEA passport
-
National Identity card
-
Residence documentation
Those EEA/Swiss nationals with a digital status under the EU Settlement Scheme will have to provide evidence through the online checking service (Online Share Code).
The online service is also available to EEA/Swiss nationals with a Frontier Worker Permit, as well as to people of any nationality with a Biometric Residence Permit (BRP). Manual checks can still be used for anyone with a physical BRP.
The following documents have been added to List A and List B as acceptable documents to evidence Right to Work in the UK:

Documents issued to EEA/Swiss nationals and their family members by Crown Dependencies (the Bailiwick of Jersey, the Bailiwick of Guernsey, or the Isle of Man)

Irish passports (which includes the Irish passport card)
In addition, a short exceptions list has also been included for EEA citizens without Settled Status, which includes documents such as:

Frontier Worker Permit
-
Service Provider of Switzerland Visa

Reason for the Change
Ahead of the Brexit transition rules coming into effect on July 1st, 2021, the Home Office has made changes to the employer’s guidance in relation to the acceptable document list for conducting RTW checks on June 18th.

All customers using TrustID.
How will this affect the TrustID Service?
TrustID will be updating the RTW service to include the published changes to List A and List B, as well as the exceptions list, and will implement these changes after midnight on June 30th, 2021.
Please note: Although the new document types will be available in TrustID, Fourth will still be carrying out the required development across Fourth ATS and WFM to support the use of these for conducting RTW checks. As such, we strongly urge all ATS customers not to use these document types until further notice to prevent delays and/or issues when during the hiring process.
You can continue to use Online Share Codes to carry out RTW checks without any impact to this service and details of this functionality can be found in this article.
