If an employee is TUPE transferred and the incorrect start date is entered is it possible to back date the start date without any issues?

Yes it is possible to back date a payroll start date however only users with the permission to change payroll start date will be able to do this. This is in the HR template.

The employee also needs to be attached to payroll.

There is no issue from a system perspective but if you are concerned about any legal implications under TUPE, I would take legal advice.
